HC granted temporary bail to Darshan for 6 weeks | Latest Indian News

The Karnataka High Court on Wednesday granted interim bail to the actor. Darshan Thugudeepaarrested more than four months ago in connection with a murder case, allowing him to be temporarily released from prison for six weeks on medical grounds and undergo spinal surgery.

Hours after the court order, Darshan (47), who was lodged in Ballari jail after his arrest on June 11 in the Renukaswamy murder case, was released from jail in the evening after the jail authorities completed formalities to obtain the court order.

In its order, a bench of Justice S. Vishwajeet Shetty also laid down specific conditions, asking him to surrender his passport in the trial court and fulfill his personal bond 2 lakhs with two sureties of the same amount. The court allowed Darshan to consult a doctor of his choice, asking him to submit a detailed medical report within a week.

“Every person, including prisoners, has the right to adequate and effective medical treatment… A health condition, if not promptly addressed, can lead to serious consequences that endanger the life and health of a person that cannot be restored,” the panel noted in his report. order.

“The applicant’s medical condition cannot be removed from prison and a specialist doctor has said that the operation must be carried out in a specialist hospital. The imminent or imminent danger if the operation is not carried out is clearly stated in the medical report,” the court noted while granting interim bail to Darshan.

A decision on his regular bail remains pending in the high court after it was earlier rejected by a lower court.

The Supreme Court order requires Darshan to be hospitalized immediately upon release and submit a report indicating the planned date of surgery, period of hospitalization and any subsequent treatment required. Darshan was also banned from speaking to the media or making statements on social media, especially regarding his health or case.

He has been asked to appear before the trial court at the end of his bail period unless further orders are made.

Darshan, his friend Pavitra Gowda and 15 others are accused of kidnapping and murder of Renukaswamy (33 years old), resident of Chitradurga district. According to the police, the victim, a fan of the actor, sent obscene messages to Pavitra, which enraged Darshan and allegedly led to his murder. His body was found on June 9 near a storm drain near an apartment in Sumanahalli in Bengaluru.

During the hearing of the interim bail petition in the high court, senior advocate S Nagesh, representing Darshan, on October 28 said that the actor’s back pain, which was reportedly not responding to the physiotherapy provided in jail, required a more intensive surgical approach . The State was represented by Public Prosecutor P. Prasanna Kumar.

Reacting to the court order, Karnataka Deputy Chief Minister D.K. Shivakumar said, “I will not question the court’s verdict. The government will respect the court’s decision.”

Renukaswamy’s family declined to comment on the court’s decision to grant bail to the accused, but expressed confidence in the judicial process. “The perpetrators must be punished. Bail was granted in accordance with the legal system, we cannot comment on this. We believe that those responsible will be punished. We believe in the law and the police. Treatment (Darshan) is a matter for the doctor, himself and the court, we do not want to comment on it,” said the victim’s father Kashinath Shivanagudar.
