Cuyahoga grand jury indicts three for shooting at Cleveland police

CLEVELAND, Ohio — A Cuyahoga County grand jury returned an indictment charging three people with attempted murder for shooting at police officers in Cleveland.

Police said that on Oct. 28, Ray Agosto, Wayne Agosto, 32, Dakota Green, 25, and Dylan Mitchell, 31, were near Denison Avenue and West 31st Street in Cleveland when CPD officers who were already at the area is looking for 39-year-old Ray Agosto in connection with an incident that occurred with his downstairs neighbors a few days earlier.

Wayne Agosto fired several shots at officers, who returned fire, police said. Ray Agosto and Dakota Green fled the scene. Wayne Agosto and Dylan Mitchell were arrested at the scene.

Wayne was taken to a nearby hospital after being shot by police.

“I am grateful that the Cleveland officers were not harmed while attempting to apprehend Ray Agosto,” said prosecutor Michael O’Malley. “These violent gun-toting predators have no regard for our community and I am glad they are off our streets.”

Police said Ray Agosto approached neighbors again on Oct. 28 and said he forgot his keys. When she opened the door, Agosto had a gun and a knife in his hand. He tried to hit her in the face but hit the wall. The victim’s husband heard Agosto and closed the front door. Agosto fled the scene.

Later that day, Ray Agosto, Wayne Agosto, Dakota Greene and Dylan Mitchell were near Denison Avenue and West 31st Street in Cleveland. CDP officers were already actively searching the area for Ray Agosto in connection with the above incidents. Wayne Agosto then fired several times at the officers, who returned fire. Ray Agosto and Dakota Green then fled the scene. Wayne Agosto and Dylan Mitchell were arrested at the scene and Wayne was taken to a nearby hospital for treatment of his injuries.

Dakota Greene was later found at the apartment complex and arrested.

The next day, near West 131st Street in Cleveland, Ray Agosto was arrested after a two-hour standoff with the U.S. Marshals Service Northern Ohio Fugitive Task Force, the Cleveland SWAT team and police.

The investigation is being conducted by CPD and is ongoing.
