Probation sentence and community service linked to woman’s role in fight at Geneva Bar

Another woman charged in an April 2023 bar fight that ended in gunfire at a Geneva bar and grill was sentenced Wednesday to probation, community service and a suspended prison sentence after she pleaded guilty to disorderly conduct.

Mikayla Jean Olson, 24, originally faced one count of fifth-degree assault and one count of third-degree riot, but pleaded guilty to disorderly conduct in August as part of a plea agreement.

The plea deal included, among other things, 60 days of deferred jail time, no additional jail time, one year of probation and conditions to not enter bars/liquor stores and stay away from Geneva bars.

Video obtained from the bar showed co-defendant Desiree Nadine Klemp, 29, starting the fight when she threw a large drink and a cup in the face of several people standing outside the bar after the song she had paid for was skipped from the musical machine. A general argument began inside. The video shows Olson throwing a drink at a man who was attacked by others.

The fight eventually moved outside, where Dustin Smitty reportedly fired into the air in the parking lot and then fired at a speeding car. He pleaded guilty to two counts of second-degree assault, one for each of the two people in the vehicle that was shot at. In December he was sentenced to three years and three months in prison.

Robert James Smitty pleaded guilty to fifth-degree assault in the case and was sentenced in January to one year of supervised probation.

Klemp also pleaded guilty in August to an amended count of disorderly conduct – fighting or fighting and will be sentenced Oct. 30.
