What was the verdict of the High Court in the Gachagua case?

On Thursday, October 31, a three-judge panel of Justices Anthony Mrima, Eric Ogola and Freda Mugambi overturned orders that had prevented Kithure Kindiki from taking office as Deputy President.

This comes after petitioners David Munyi and Peter Gichobi filed a petition in court on October 18 to prevent Kindiki from being sworn in until Gachagua’s impeachment case is heard.

During the proceedings, Gachagua argued that Kindiki’s appointment as vice president was illegal because the outgoing home affairs minister was not eligible to stand in the elections because he was not a member of Kenya’s ruling party. UDA.

They also alleged that Kindiki was still serving as the country’s interior cabinet secretary when President William Ruto appointed him to replace Gachagua.

In its ruling, the three-judge panel said the office of vice president as provided for in the 2010 Constitution cannot remain vacant and stressed the need for Kindiki to be sworn in.
