New Delhi, The Delhi High Court on Friday asked Tihar Jail authorities to provide necessary medical assistance to separatist leader Yasin Malik, who has been sentenced to life imprisonment in a terrorism case and is reportedly on a hunger strike.

Justice Anup Kumar Mendiratta, while issuing notice to the Centre, Delhi government and Tihar Jail authorities seeking his medical attention, also sought a health report.

Malik’s lawyer said that his client has been on a hunger strike since November 1 and needs urgent hospitalization.

“Issue a notice. Have the warden request a report on the plaintiff’s medical condition. with prison rules,” the court ruled.

On May 24, 2022, a Delhi trial court sentenced Malik to life imprisonment after finding him guilty of various offenses under the stringent Unlawful Activities Act and IPC.

The National Investigation Agency has filed an appeal in the high court seeking enhancement of his life sentence to a maximum penalty of death.

In his statement before the high court, Malik said he has “serious heart and kidney ailments” and is currently facing a “life and death situation.”

“There have been instances where the applicant was seriously ill or his presence was mandatorily required in the trial court, but as per 268 orders of the CrPC, he was not taken to the hospital or produced before the court,” it alleged.

The statement further alleged that since Malik was a political activist, the authorities rejected his request for a proper medical investigation.

“Having suffered from the dishonest and negligent acts of the respondents, the petitioner suffered from rashes, irregular treatment and weight loss, and every organ of the petitioner was vulnerable,” the statement said.

A similar application for medical assistance was earlier filed by Malik, but the court rejected it considering his examination by AIIMS doctors and provision of necessary medical attention to him.

The case will be heard on November 11.
