Reno County District Attorney Reminds CBD and Vape Shops of Kansas Cannabis Law

HUTCHINSON, Kan. (KSNW) – The Reno County District Attorney is warning local CBD stores and vape shops against selling illegal THC products.

The District Attorney sent out a notice to many CBD stores and vape shops to remind them of Kansas cannabis laws. It went to everyone who sells hemp products in the area.

Some local CBD stores in the area are concerned that there is a gray area when it comes to cannabis.

“It upset me because I’ve seen it over and over again in other counties where people have come forward and come to the conclusion that a business like ours is operating legally,” said Nate Hiatt, co-owner of the company. High Point Farms in Hutchinson.

Hiatt says the products the notice warns about, such as THC or Delta 8 vapes, are not sold at his store.

“We are not selling Delta 8. We made this decision due to our growth. So, we don’t want to lose our growing license. We will remain in the gray area. We’re just going to stay as legal as possible,” Hiatt said.

He said he was confused when he received the letter.

“I was a little more disappointed that it came out, I mean, as much as we try to make cannabis not such a bad thing, in Kansas it is still what it is. “‘This is bad’ is what they think,” Hiatt said.

He’s concerned that the notice could hurt small businesses like his. But District Attorney Thomas Stanton says this is not an attempt to prosecute anyone.

“We are not going to take people, businesses, products and test them for THC. But we also don’t want people to find themselves in a situation where they put themselves or their businesses at risk by selling illegal products,” said Thomas Stanton, Reno County District Attorney.

He wanted to remind him of the law after law enforcement told him that some stores had THC levels higher than the legal limit of 0.3 or less.

“I’m trying to make sure that no one is arrested and no one is prosecuted under the law. But I am going to enforce the law as the legislature wrote it. And people need to understand that,” Stanton said.

The DA recommends that people purchasing these products check the label to ensure they are using products with the legal percentage of THC.

“If you have a business that sells illegal products and makes money from it, it’s not fair to all the manufacturers who follow the law and make sure that every product they sell and put on the market is legal,” he said. Stanton.

Dad says he doesn’t plan to raid stores or create panic… but wants stores to understand and follow state laws. he encourages all businesses to consult with legal counsel to ensure they remain within Kansas laws.
