The Navajo Nation Department of Justice has filed a lawsuit against Apache County, Arizona, seeking to extend voting hours due to problems with a polling place.

The lawsuit alleges that some areas in Apache County ran out of emergency ballots, that some voters were turned away from voting because of problems with the ballot printer and that some voters were forced to leave because of long lines at polling places.

“Defendants know, or could reasonably be expected to know, that their conduct in failing to conduct elections on time throughout the voting period at the polling place in Apache County resulted in the serious burden, and in some cases, disqualification, of voting for Plaintiff. members,” the lawsuit says.

Earlier in the day, county officials said the countywide problem had been resolved, but it had created some “residual problems,” including long lines at polling places.

Arizona Secretary of State Adrian Fontes said he expects the resolution to be passed before 1900 GMT, which is when polls are scheduled to close in Arizona.
